Definitions

• Company / We / Us / Our: Unique TutorArc Pvt. Ltd., operating as TutorArc Digital.
• User: Any visitor, student, parent/guardian, educator, or institute using the Platform.
• Institute/Provider: Any individual or institution listed on the Platform offering education services (live/recorded classes, test series, assignment help).
• Services: Exam information (India & Study Abroad), listings, lead sharing, and allied features provided via the Platform.

Nature of the Platform

TutorArc Digital is a digital educational platform and marketplace that:

• Publishes exam information and discovery content for Indian & international exams.
• Enables institutes/educators to list their offerings.
• Connects interested students with relevant listed providers (lead sharing).

We do not conduct classes ourselves unless explicitly stated, do not guarantee outcomes, and are not a party to the contract between a student and a provider.

Eligibility & Account

• By using the Platform, you confirm you are legally competent to contract under applicable law.
• You agree to provide accurate information and keep it updated.
• You are responsible for safeguarding your login credentials and all activity under your account.

Listings & Enrolments

• Listing approval, ranking, and visibility may depend on quality, relevance, compliance, and Platform policies.
• When a student shows interest or enrolls, the student’s details may be shared with relevant listed providers for counseling and service fulfillment.
• Any agreement, schedule, curriculum, price, or promise made by a provider is solely between the student and that provider.

Payments, Fees & Refunds

• Payments processed via the Platform or third-party gateways are subject to their terms.
• Refunds: Governed by the provider’s refund policy. TutorArc Digital acts as a facilitator and is not responsible for disputes between users and providers.
• Platform fees (if charged) may be non-refundable unless stated otherwise.
• Chargebacks and payment disputes should first be raised with the provider and payment gateway; we may assist at our discretion.

Data Sharing, Privacy & Communications

• By submitting details or enrolling, you consent to sharing your information with relevant providers for counseling, demos, and fulfilment.
• You agree to receive communications (calls, SMS, email, WhatsApp) from us and listed providers regarding services you viewed or requested. You may opt out as described in our Privacy Policy.
• Data handling is governed by our Privacy Policy published on the Website.

Content & Intellectual Property

• Website content (text, graphics, logos, UI, compilations) is owned by Unique TutorArc Pvt. Ltd. or its licensors. All rights reserved.
• You may not copy, reproduce, distribute, modify, scrape, or create derivative works without prior written consent.
• By uploading/submitting content (e.g., institute profile, logo, description), you grant us a worldwide, non-exclusive, royalty-free license to host, display, and promote it on the Platform and our marketing channels, and you represent you have the rights to share such content.

Acceptable Use

• Do not post false, misleading, infringing, or illegal content.
• Do not spam, harass, or attempt to bypass lead/communication systems.
• Do not interfere with Platform security, scrape data, or reverse engineer.
• Do not impersonate any person or misrepresent affiliation.

Verification, Badges & Rankings

Any “verified”, “featured”, or similar labels are indicative only (where applicable) and based on internal checks or third-party processes. They are not guarantees of quality, outcomes, or regulatory approvals and may be changed, revoked, or discontinued at any time.

Third-Party Links & Tools

The Platform may link to third-party sites/services (payment gateways, communication tools, etc.). We do not control them and are not responsible for their content, policies, or practices. Use them at your own risk.

Availability & Changes

We aim for continuous availability but do not guarantee uninterrupted or error-free operation. We may add, modify, or discontinue features, listings, or access (temporary or permanent) without notice.

Indemnity

You agree to indemnify and hold harmless Unique TutorArc Pvt. Ltd. and its officers, employees, and partners from any claims, losses, liabilities, or expenses arising out of your use of the Platform, your content, or your breach of these Terms or applicable laws.

Disclaimer & Limitation of Liability

To the maximum extent permitted by law, the Platform and content are provided “as is” without warranties of any kind. We are not liable for any direct, indirect, incidental, consequential, or special damages arising from or related to your use of the Platform, your dealings with providers, or reliance on information published herein.

Suspension & Termination

We may suspend or terminate access for policy violations, legal or security reasons, or non-payment (if applicable). You may stop using the Platform at any time; certain obligations (e.g., payment dues, confidentiality, IP) survive termination.

Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms. Please review this page periodically.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Delhi, India shall have exclusive jurisdiction over disputes.
